What AI May Assist With—and What It Must Never Decide

Artificial intelligence is increasingly present in systems of justice, governance, and public decision-making. It sorts, scores, predicts, and recommends. Much of the public conversation focuses on how powerful these systems are becoming—how accurate, efficient, or scalable they may be.

That focus misses the real question.

The most important issue is not what AI can do.
It is what AI must never be allowed to decide.

There is a critical distinction that often goes unspoken: the difference between assistance and judgment. Assistance supports a decision-maker. Judgment is the decision. Confusing the two does not merely introduce technical risk—it undermines legitimacy itself.

AI can assist by organizing information, identifying patterns, and surfacing factors a human decision-maker might overlook. In that role, it can be valuable. But judgment involves more than calculation. It requires answering for consequences. It requires moral authorship. It requires a person—or an institution acting through people—who can be held accountable.

No system, however advanced, can bear responsibility.

This boundary matters most where power is exercised over others: policing, courts, administrative determinations, and governance more broadly. These decisions do not derive their legitimacy from efficiency or accuracy alone. They derive legitimacy from the fact that a human authority stands behind them—someone who can explain the decision, defend it, revise it, or answer for it when harm occurs.

When a system crosses from assisting judgment to replacing it, responsibility does not disappear. It becomes obscured.

This is where danger enters quietly. Not through malicious intent, but through delegation without reflection. When an algorithm produces a recommendation that is treated as decisive, human authority does not vanish—it retreats. Over time, the system becomes the apparent decision-maker, while human actors become its operators. Accountability becomes diffuse. Outcomes feel inevitable. And when harm occurs, no one quite knows where to place responsibility.

That is not progress. It is abdication.

The question, then, is not whether AI should be used in justice systems. It already is. The question is whether institutions will preserve a clear boundary between tools that inform decisions and authorities that own them.

Judgment is not a technical function. It is a moral one. It cannot be automated without changing the nature of authority itself.

If we fail to draw this boundary clearly—now, while these systems are still being integrated—we will not lose control all at once. We will lose it gradually, through convenience, deference, and the quiet erosion of responsibility.

And by the time we notice, the most important decisions will still be made by humans—just without anyone willing to admit it, explain it, or answer for it.
